Remodeling over $100,000: when you need a sewer lateral certificate

Last updated 2026-11-03. Checked against the official sources listed at the end of this page.

Reviewed by East Bay Sewer Inspection staff

Quick answer: In the EBMUD program area, a building or remodeling project over $100,000 needs a sewer lateral Compliance Certificate before the city's final permit sign-off. The lateral work can happen before, during or after the remodel, but the certificate must reach the permitting agency before final sign-off. Changing your water meter size is a separate trigger.

When is the certificate due?

The certificate must be in hand, and a copy given to the city or county permit staff, before final inspection and permit sign-off. EBMUD says the lateral work "can be done before, after, or during the building/remodeling work at your discretion" (Building or Remodeling). If the home already has a certificate, check its expiry date with EBMUD (how to check).

What are the steps?

From EBMUD's Building or Remodeling guidelines:

  1. B1. Have a plumbing contractor check the lateral for leaks and defects. A camera (CCTV) review should also look for a gas line cross bore. Call PG&E at (800) 743-5000 if you suspect one.
  2. B2. Get city permits before any lateral work. In Emeryville this step is required even if no repair or replacement is done.
  3. B3. Repair or replace the lateral if needed.
  4. B4. Schedule the EBMUD verification test online and pay the Compliance Certificate fee ($407 as of July 1, 2026, per EBMUD fees). Your contractor sets up the air or water pressure test and EBMUD witnesses it.
  5. B5. Pass and print the certificate.
  6. B6. Give a copy to the permitting agency before final sign-off.

Do I need to certify the whole lateral?

In Oakland, Piedmont, Emeryville, El Cerrito, Kensington and Richmond Annex, the owner is responsible for the whole lateral to the public main. In Alameda and Albany, it's the upper lateral only (FAQ). See who is responsible in each city.

Changing my water meter size

Increasing or decreasing your water meter size is also a trigger. Submit the Compliance Certificate (or Exemption Certificate) to EBMUD's New Business Office to finalize the Water Service Application (Changing Water Meter Size; Exemption Certificate).

Berkeley remodels

Berkeley requires a Sewer Lateral Certificate before a building permit is issued for major construction such as remodels. Where testing or repair isn't possible before construction, or replacing the lateral is part of the project, you can ask for a deferral in your plan-check response. If approved, the permit is issued but not finalized, and no Certificate of Occupancy is issued, until the certificate is obtained (City of Berkeley PSL).

Frequently asked questions

Does a kitchen remodel trigger the EBMUD sewer lateral rule?

Only if the building or remodeling work exceeds $100,000. Then a Compliance Certificate is needed before the city's final permit sign-off.

Can I do the sewer lateral work after the remodel?

Yes. EBMUD says the lateral work can be done before, during or after the remodel, but the certificate must be given to the permitting agency before final sign-off.
